Terms of Service

1. Agreement and Operator

These Terms of Service ("Terms") govern your use of the website, account, and booking services operated by Five JS & A K Luxury Transport LLC ("Company," "we," "us," "our"). By accessing our services, creating an account, requesting a booking, or completing a booking, you agree to these Terms.

Our services are intended for adults only.

2. Service Area

We provide transportation services in selected U.S. regions, including our listed Northeast coverage areas. Availability varies by route, timing, operations, and driver availability.

3. Accounts and Eligibility

You are responsible for maintaining accurate account information and for all activity under your account credentials.

4. Booking Requests and Confirmation

Booking submissions are requests until confirmed. A booking is considered confirmed only after a payment hold is placed and you receive a booking confirmation notification.

Even after confirmation, we reserve the right to modify, reschedule, or cancel bookings in accordance with these Terms.

5. Pricing, Charges, and Payment

  • Displayed quotes are estimates and may be adjusted at final confirmation where needed.
  • Final charges may include adjustments for route changes, additional stops, waiting time, tolls, fees, cleaning/damage, legal compliance costs, and other booking-specific operational factors.
  • Payment processing is handled through third-party providers (such as Stripe).

6. Customer Cancellation and No-Show Policy

Based on current platform logic, cancellation timing is evaluated against the scheduled pickup time.

  • More than 24 hours before pickup: free cancellation.
  • Between 4 and 24 hours before pickup: 50% late cancellation fee may apply.
  • Within 4 hours of pickup: online self-service cancellation may be unavailable.
  • After pickup time passes: treated as no-show and full charge may apply.

7. Company Cancellation, Denial of Service, and Account Bans

We reserve the right, in our sole discretion, to cancel, reject, modify, or discontinue any booking at any time, for any reason, with or without notice.

We also reserve the right, in our sole discretion, to suspend or permanently ban any account and deny service to any person, at any time, for any reason, with or without notice.

This includes, without limitation, safety concerns, abusive or harassing conduct, fraud risk, payment issues, chargebacks, policy violations, operational constraints, or legal requirements.

8. Wait Time and Passenger Readiness

Standard wait time is up to 30 minutes. Drivers may depart earlier based on operational or safety considerations. If a passenger is not ready, the booking may be treated as a no-show and charged in full.

9. Refund Policy

Unless required by law, refunds are generally limited and may be issued when we determine there was a mistaken charge without actual service fulfillment. Approved refund decisions are made at our discretion and may require verification.

10. Rider Conduct Rules

You agree not to engage in prohibited behavior, including:

  • Illegal activity or transport of prohibited or unlawful items.
  • Smoking or vaping in the vehicle when prohibited by company policy or law.
  • Harassment, threats, discrimination, or abusive behavior toward drivers or staff.
  • Unsafe conduct that may risk injury or property damage.
  • Intentional or negligent damage, soiling, or misuse of company vehicles.

11. Communications Consent

By using our services, you consent to receive booking-related and transactional communications by email and SMS. Message and data rates may apply depending on your carrier plan. Carrier delivery is not guaranteed.

12. Force Majeure

We are not liable for delays, service changes, or cancellations caused by events beyond our reasonable control, including weather, road closures, traffic incidents, civil emergencies, labor disruptions, technology outages, government actions, or other force majeure events.

13. Limitation of Liability

To the fullest extent permitted by law, our total liability for claims arising out of or related to a booking is limited to the amount paid for the affected booking. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or lost opportunities.

14. Governing Law and Venue

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles. Unless otherwise required by law, disputes shall be brought exclusively in the state or federal courts located in Massachusetts, and you consent to personal jurisdiction in those courts.

15. Changes to Terms

We may update these Terms from time to time. We will provide notice of material changes via email and in-app notice, and we will post updated Terms on this page. Continued use of our services or new bookings after updates become effective constitutes acceptance of the revised Terms.
